§1.
GENERAL INFORMATION
1.1
The New Horizons Association, with its registered address in Warsaw (00-153) at Zamenhofa 1 Street, entered in the register of associations, other social and professional organizations, foundations, and independent public healthcare facilities and in the register of entrepreneurs kept by the District Court for the Capital City Warsaw, 12th Commercial Department of the National Court Register, KRS 0000162000, NIP 525-22-71-014, REGON 015503904 (hereinafter "the Organizer") is the organizer of the 21st New Horizons International Film Festival (hereinafter "the Festival"), including the New Horizons International Competition (hereinafter "the Competition"), which will take place as part of the Festival.
1.2
The Festival shall be held from 22 July to 1 August 2021 in Wrocław, at the locations selected by the Organizer.
1.3.
Detailed information about the Festival and the sections of the Festival program can be found on the Festival's official website: www.nowehoryzonty.pl.
1.4
In accordance with the Organizer's decision for participation in the Festival, feature, documentary, animated, and experimental films, as well as innovative visual productions, may be submitted provided they were completed after 1 January 2020.
1.5
Films qualified for the New Horizons International Competition should be delivered to the Organizer on a DCP copy. If this format is not available, in exceptional circumstances an HD file or a blu-ray disc is allowed, but only with the Festival Organizer's consent.
1.6
The Organizer stipulates that films that have already been screened in Poland may not be submitted for the Competition. In the case of the Competition section, the Festival prefers world, international, and European premieres.
1.7
The Organizer entrusts the selection of films and invitations to submit films to the Festival to the Festival Selection Committee. The Festival Selection Committee reserves the right to choose the section in which a submitted film will be screened.
1.8
Films that have been confirmed for participation in the Festival may not be withdrawn from the program after 15 June 2021.
§2.
NEW HORIZONS INTERNATIONAL COMPETITION
The Competition is a platform for the presentation of bold artistic cinema that seeks new forms of expression extending far beyond the boundaries of conventional film. It is a place for cinematic visionaries and uncompromising artists who have the courage to follow their own path in defiance of popular trends and to talk about significant issues using their own unique language. The Competition includes innovative feature films, creative documentaries, and experimental and animated films.
2.1. The Competition is open to films that:
are more than 60 minutes in length;
were made after 1 January 2020, in accordance with §1, paragraph 1.4;
have not already been shown at any public screenings in Poland, with the understanding that the Organizer prefers world, international, and European premieres.
2.2. Prizes awarded in the Competition*:
The Grand Prix and EUR 15,000 awarded by an international jury will go to the director of the highest-rated film.
The Audience Award for best film as judged by audiences.
The Organizer stipulates that none of the above prizes may be awarded to joint winners; only one winner may be chosen by the jury.
§3.
NON-COMPETITION SECTIONS
3.1
Gala Screenings; Masters; Discoveries - films that have won awards at international festivals, including those made both by renowned artists and discoveries.
3.2
The Visual Front - a meeting point of cinema and art. A space of confrontation for artists with film forms, and filmmakers with conceptual narratives of visual and performative arts. The Visual Front is not a competition, but a platform connecting gallery and festival circuits. It is a platform for showing visual artists films and film projects exploring the art world.
3.3
Third Eye - this section explores modernity, by investigating the trends and ideas that define it as such, while remaining sensitive to current political and cultural contexts.
3.4
Shortlist - selection of the most interesting and most innovative Polish short films
3.4.1
Shortlist is open to films:
are maximum 30 minutes in length;
In Shortlist section the Polish premiere is not required.
§4. DEADLINES, MATERIALS, AND SCREENINGS
4.1
The term for the submission of applications: January 4th - March 7th 2021.
4.2
The condition for admission to selection is to provide, by the deadline referred to in the above paragraph, a completed application form with a set of required attachments, including a link to the on-line preview copy of the film with English subtitles. The password for the link must remain unchanged throughout the selection process, from the date of the film's submission until the official announcement of the festival program. If it is necessary to change the password during the selection process, the applicant shall immediately notify the Organizer and provide the new password.
4.3
Due to the large number of applicants, the Organizer reserves the right to announce the selection results no later than 40 days prior to the start of the Festival.
4.4
The Organizer will inform about the results of the selection only those Applicants whose films were selected for the program. The Festival Selection Committee is not obliged to justify their selection decisions.
4.5
The Festival presents films in their original language with English and Polish subtitles. The Organizer prefers copies with English subtitles. Polish subtitles are presented using an electronic system for synchronizing subtitles. Applicants must provide the organizers with a copy of the original dialogue, English subtitles, and a link to the film.
4.6
For every selected film, the Festival must receive: a synopsis of the film, stills from the film, the director's biography and filmography.
4.7
Each film can be screened at the Festival no more than four times.
4.8
The Festival Directorate shall prepare the screening schedule.
§5.
PROMOTION
5.1
For selected films, Applicants will be asked to submit promotional materials (including posters, flyers, trailers, etc.).
5.2
The Organizer reserves the right to use fragments from selected films (of no longer than three minutes), and also to include information about the film on the Festival website and in all other promotional publications related to the Festival (including the catalogue, the program, press releases, etc.).
5.3
The Organizer reserves the right to use promotional materials both during and after the Festival.
§6.
TRANSPORT AND RESPONSIBILITY FOR COPIES OF FILMS
6.1
The broadcast copies of the films selected for participation in the Festival should be delivered in physical form to the Organizer's office in Warsaw or in electronic form as a link to download the copy. In either case no later than July 5, 2021.
6.2
The cost of transport for copies of films will be covered by the Organizer, unless otherwise specified:
a) to and from Poland if a copy is sent from and returned to a company that is making it available (Producer/Sales Agent).
b) one-way (to Poland only) if a copy is sent to another film festival.
6.3
All copies of the films presented at the Festival are insured by the Organizer from the moment of delivery to the Organizer until their transfer to a courier for return delivery.
6.4
The Organizer of the Festival is responsible for the safety of each copy from the moment it is received from the transport company until it is handed over again to the transport company provided that the liability of the Organizer for damaged or lost copies is limited to the cost of making a new copy in accordance with applicable laboratory rates (a standard copy).
6.5
Damage to a copy of a film must be reported to the Organizer's office in writing within one month from the date of its return.
6.6
All films presented at the Festival will be returned no later than 15 September 2021 unless the Organizer and the Applicant agree otherwise.
6.7
In the case of broadcast copies received in electronic form, the Organizer will make every effort to prevent such a copy from being in the possession of third parties and shall remove it from all its servers immediately after the end of the festival.
§7.
RIGHTS TO FILMS
7.1
The Festival may receive submissions of films to which the Applicant holds rights, including copyright and related rights that permit submission of the film to the Festival, as well as the screening thereof during the Festival. In particular, an Applicant submitting a film to the Festival is obliged to ensure that:
1) they hold copyrights to the submitted film (including rights to the songs used in the film) or the applicable licenses in this regard;
2) they hold related rights to the submitted film or the applicable licenses in this regard,
3) the dissemination of images of people in connection with the submission of the film to the Festival or the screening of the film during the Festival does not infringe the rights of said individuals.
7.2
The Organizer reserves the right to refuse the selection of a film for the Festival, suspend the participation of a film in the Festival, or the right to withdraw a film from the Festival upon becoming aware of the fact that a film submitted to the Festival or its screening during the Festival may infringe copyright, related rights, or personal rights of third parties.
7.3
Any applicant submitting a film to the Festival is obliged, in the case of a third party claiming infringement by the Organizer of copyright or related rights to the film or its individual components or personal rights, to indemnify the Organizer for all damages and costs associated with any claims made (Art. 392 of the Civil Code).
7.4
The provisions of paragraphs 7.1-7.3 shall also apply in relation to the promotional materials referred to in §5.
§8.
PERSONAL DATA
8.1
The applicant entrusts the Organizer, within the meaning of Art. 31 of the Act of 29 August 1997 on Protection of Personal Data (Journal of Laws of 2002, No. 101, item. 926, as amended), with the processing of their personal data.
8.2
This includes personal data about the persons listed on the application form and the persons listed in the budget, in particular filmmakers and performers. This includes the following personal data:
1) Name and surname;
2) E-mail address;
3) Telephone number;
4) occupation.
8.3
The Organizer may process the entrusted personal data for the purposes of selecting a film for the Competition, as well as for the purposes of showing the film.
8.4
The Organizer is entitled to further entrust the processing of personal information to others to the extent necessary.
§9.
FINAL POINTS
Submission of a film to the Festival implies acceptance of these regulations. Cases not covered by the regulations will be resolved by the Director of the Festival.
Prizes won in competitions are subject to taxation, pursuant to Art. 13(2) of the Act on Personal Income Tax (UPDOF), concerning participation in competitions in the fields of science, culture, the arts, and journalism. Prizes will be paid following the deduction of a withholding tax at the rate of 18%, taking into account deductible costs of 20%.
In the case of winners who are not Polish residents, the Association, in accordance with Art. 29(1)(1) of the UPDOF, shall collect a tax deposit at the rate of 20%, excluding deductible costs. In the event that a non-resident presents a tax residence certificate, the Association shall collect a tax deposit in the amount specified in the relevant agreement for the avoidance of double taxation.
